Mindful Mindset - our Privacy Policy

Mindful Mindset is a trading name used by Delizia Diaz who is the “data controller” for the purposes of this Privacy Policy. We are registered with the ICO (Information Commissioner’s Office) under registration number ZB215640. We are also registered as a certified Mindfulness and Compassion teacher with Mindfulness UK.

At Mindful Mindset we understand you will be sharing with us information that is particularly personal and private to you. We will take every step to ensure that your privacy rights are respected at all times.

The type of personal information we collect and how we use it

We currently collect and process the following information:

  • Personal identifiers and contact details (full name, email and telephone number) for the purposes of keeping in touch about the delivery of mindfulness services and to send you newsletters and other communications where you have consented to these

  • Next of kin details for emergency contact purposes

  • Details of your progress to assess how your mindfulness practice is evolving over time

  • Physical and mental health information (subject to receiving your consent to this) for the purposes of (i) assessing that mindfulness is suitable to your circumstances and (ii) to discuss any adjustments to our session that your condition might require

  • Financial details to manage your service payments where those services are fee bearing

Most of this information will be supplied by yourself at the start of our interactions and on an on-going basis, as our sessions progress.

In limited circumstances, we may share this information with relevant authorities in case of emergency or for tax and other legally mandated purposes.

Under the data protection legislation, we are required to inform you about the legal reasons we rely on for processing this information. These are as follows:

  1. We have a legal obligation (e.g. for tax reporting and other legally mandated purposes).

  2. We have a contractual obligation (e.g. where handling your information is needed for the purposes of providing you with the services you have subscribed to).

  3. We have a legitimate business reason (e.g. to answer any enquiry your may have when contacting us by email or through webforms or to aggregate your data for the purposes of analytics).

  4. For your vital interests (or those around you) in the unlikely event that we should ever assess that you could be a risk to yourself or to others.

  5. Your consent (e.g. to send you newsletters and services communications or to use your physical and mental health information for the purposes of assessing the suitability of mindfulness to your personal circumstances). You are able to remove your consent at any time by contacting us (contact details appears below). 

How we store your personal information

Your information is securely stored in separate folders accessible solely and strictly on a need-to-know basis, on systems that are suitably password protected or encrypted as the case may be.

We keep your personal information for no more than 5 years from the end of our last interaction. We will then dispose of your information by permanently purging it from our emails and storage systems.

Your data protection rights

Under data protection law, you have rights including:

  • Your right of access - You have the right to ask us for copies of your personal information.

  • Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

  • Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.

  • Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.

  • Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

  • Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. Please contact us at info@mindfulminset.uk if you wish to make such a request.
